Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AuraGuardian cloud security platform and agent software (the "Service") operated by AuraGuardian ("we", "us", "our"). By using the Service, you agree to be bound by these Terms.

1. Service Description

AuraGuardian is an application-layer security agent that runs inside your PHP runtime. The agent communicates with our cloud platform to receive encrypted security engine payloads, enforce threat rules, and report security telemetry. We act as a Data Processor when handling your visitors' traffic data.

2. Account & License

• You must provide accurate registration information and keep it current.
• Each license key is assigned to your account and must not be shared, resold, or sublicensed.
• You are responsible for all activity under your account and license keys.
• The number of domains you may protect is limited by your subscription plan.

3. Subscription & Billing

• The Service is offered on a subscription basis. Pricing is displayed on our website and at checkout.
• Subscriptions auto-renew unless canceled before the current billing period ends.
• A 48-hour grace period applies after subscription expiry, during which the agent continues to function. After the grace period, agents silently stop enforcing protection — your website continues to run normally without any interruption, it simply loses the security layer.
• Refunds are handled on a case-by-case basis. Contact support within 7 days of purchase.
• We reserve the right to change pricing with 30 days advance notice.

4. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or extract the encrypted security engine payload.
• Redistribute, resell, or sublicense the Service or its components.
• Use the Service to facilitate illegal activity, censorship, or discriminatory blocking.
• Attempt to circumvent license limits, domain restrictions, or rate limits.
• Interfere with or disrupt the integrity of the platform or its infrastructure.

5. Intellectual Property

The security engine logic delivered to your server as an encrypted payload is our proprietary intellectual property. It is licensed for execution on your server in connection with an active subscription only. The thin-client agent code (agent.php) is provided as-is for integration purposes and may not be modified to circumvent licensing or security controls.

6. Data & Privacy

Our collection and use of data is governed by our Privacy Policy. By using the Service, you acknowledge that visitor IP addresses, user agents, and request metadata will be transmitted to our platform for threat analysis.

You are responsible for informing your website visitors about AuraGuardian's data processing in your own privacy policy and, where required, obtaining appropriate consent.

7. Service Level & Availability

• We target 99.9% uptime for the /api/verify endpoint.
• If the API is unreachable, agents fail-open: they allow traffic based on the last cached engine payload.
• We reserve the right to perform maintenance with reasonable advance notice.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS". To the maximum extent permitted by law:

• We do not guarantee that the Service will block all threats or prevent all unauthorized access.
• We are not liable for damages resulting from blocked legitimate traffic, service outages, or security incidents beyond our reasonable control.
• Our total liability under these Terms shall not exceed the fees you paid in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the Service, your violation of these Terms, or your failure to comply with applicable data protection laws.

10. Termination

• By you: You may cancel your subscription at any time. Access continues until the end of the billing period.
• By us: We may suspend or terminate your account for violation of these Terms, non-payment, or abusive behavior, with written notice where practicable.
• Upon termination, your license keys are invalidated and agents will cease to receive engine updates.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which the platform operator is incorporated. Disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.

12. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Aura Shield — Acceptable Use Policy

Aura Shield is AuraGuardian's adaptive bot-mitigation response engine. It allows you to configure the response page served to traffic classified as automated or malicious by the protection agent.

Permitted uses of Aura Shield include:

• Serving challenge pages, access-denied responses, or alternative content to traffic identified as bots, scrapers, or automated threats.
• Protecting proprietary content, pricing data, and intellectual property from unauthorized automated harvesting.
• Reducing ad-fraud exposure by filtering non-human clicks before they reach advertising landing pages.
• Preventing credential-stuffing, account-takeover, and brute-force attacks by presenting bot-mitigation responses.

Prohibited uses of Aura Shield include:

• Manipulating search engine rankings by serving different content to search engine crawlers than to human visitors for the purpose of SEO manipulation.
• Deceiving advertising network review processes by presenting compliant content to reviewers while serving non-compliant content to end users.
• Circumventing the terms of service of any third-party platform, including but not limited to Google Ads, Meta Ads, or affiliate networks.
• Serving content designed to phish, defraud, or mislead end users.
• Any use that violates applicable laws, regulations, or the rights of third parties.

AuraGuardian reserves the right to suspend or terminate access to Aura Shield for any account found in violation of this Acceptable Use Policy, without prior notice. You are solely responsible for ensuring that your use of Aura Shield complies with all applicable laws and third-party terms of service.
